The website https://www.dogequipmentaustralia.com.au  (the “website”) is owned and operated by Dog Sport Equipment .com.au (ABN 72 308 207 783), and referred to as Dog Sport Equipment , “we”, “our”, “us” or the “business”. The business includes representatives, directors, employees and advertisers. “You” and “your” means the user or customer of this website.

Your use of the website constitutes that you have read and understand these Terms of Service (‘Terms”) and agree to abide and be bound by these Terms at all times. If you do not accept these Terms, you must leave the Website, and refrain from accessing or using the Website in future. 

Order and Cancellation

You must be at least 18 years old to place an order with Dog Sport Equipment.  

When you place an order to purchase a Product from the Website (“Order”), you will be required to provide information including your full name, billing and shipping addresses, contact phone number, and email address. You are responsible for ensuring that any information you provide to us is complete and correct. We are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us with inaccurate or incomplete information.

You shall pay for the product in full when you place an order, by supplying us with your credit or debit card details. In any event, we shall not be bound to accept the order before we have received and cleared the payment in full.

When you submit an order through the website, you agree to abide and be bound by the prevailing Terms. A confirmation and acceptance of your order with your order details will be sent to you and that a contract between you and us has been formed in relation to the sale and purchase of those Product(s).

Dog Sport Equipment  reserves the right to decline any order, for any reason. If an order has been declined, you will be provided a store credit or a full refund.

If payments are made on the weekend or public holiday, the order will not be processed until the next business day.

We will confirm that the Products have been dispatched to you by sending you shipping email confirmation. This email confirmation is evidence that we have dispatched the Product(s) to you.

Sale of Goods

These Terms govern the sale of all the goods available that are displayed on our website at the time you access it.  This includes all product(s) listed as being out of stock.  All information, descriptions, or images that we provide about our goods are as accurate as possible.  However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods we provide.  You agree to purchase goods from our website at your own risk.

We reserve the right to cancel the whole or any part of an Order (including any Orders that we have accepted) at any time if we form the view that it is necessary, including without limitation, if:

(a) any Product in the Order is not available;

(b) there is an error or omission in the price or description of any Product in the Order or on the Website;

(c) we reasonably believe you are in breach of any term or condition of these Terms; or

(d) payment in respect of the Order is unable to be processed. 

If we cancel all or any part of your Order, we will endeavour to notify you within a reasonable time and will refund any payment received. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

Payments

We accept credit card and debit cards as payment methods on our website.  When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms, we reserve the right to cancel or reverse your transaction.

Pricing

All prices in Dog Sport Equipment .com.au are quoted in Australian Dollars (AUS).

Dog Sport Equipment  reserve the rights to change prices for products displayed at our website at any time without notice. We make every effort to ensure the accuracy of our pricing. However, if an error occurs, we reserve the right to refuse to accept further orders and to cancel any orders already placed at the incorrect price.

Shipping and Delivery

We only deliver to Australia at present. The information on this site is intended and applicable for Australian consumers only.

You will be required to pay delivery charges in addition to the price for the goods you purchase.

• A minimum $12 handling and shipping fee applies to all deliveries.
• Additional costs may apply depending on the size of the order.
• Australia Post is typically used for smaller items, while other couriers are used for larger items.
• Larger-sized orders, such as jumps, usually incur shipping costs exceeding $80.
• You will be contacted prior to shipping to confirm shipping costs if the amount exceeds $12.

You are required to provide us with a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us with inaccurate or incomplete information.

When you purchase goods from our website, the goods will be delivered through standard delivery by independent courier or Australia Post.  Delivery will take place as soon as reasonably possible. Estimated shipment times may change due to changes in supply or conditions beyond our control. Please note that delivery times do not include weekends and public holidays. Content on the Website

Dog Sport Equipment  welcome feedback on our products from you. As a courtesy, we ask that you do not use obscene, profane or threatening language in messages. You are solely responsible for your messages and we are not liable for any content submitted by you. We reserve the right to remove the content you submit at any time.

You acknowledge that any information displayed on the Website or social media is intended to be general information only and should not be considered professional advice or a recommendation to acquire any product or service.

We do not endorse or guarantee the accuracy of any content posted or displayed by users. The displaying of any user content on the Website or social media in no way implies our endorsement or recommendation of any such information, product or service referred to or promoted in that content.

You acknowledge and agree that you will exercise all due care and caution in, and that you are solely responsible for, entering into any transaction, arrangement or agreement for the sale, purchase or consumption of information, products and/or services via the Website.

You agree that you are solely responsible for any content or information that you provide or post to the Website or social media.

Damage or Faulty Returns

Refund request must be made within 30 days after receipt of your goods by notifying Denver Design via idogsportequipment@gmail.com in the unlikely event that your item arrives damaged, faulty, is significantly different from description advertised or is found to be defective. 

To make a claim, you must provide us with a copy of your receipt or any kind of proof showing that you purchased the item from us. You need to also describe the problem precisely and provide evidence (photos or short video clip if more appropriate) to support your claim, and state whether you are requesting a replacement, refund or credit.

Once assessed and approved by our customer service team, you will be contacted to proceed with the return, refund or replacement process (return postage paid by us). Please do not attempt to return the item without prior approval by us.

Once written approval is received a return Registered Post label will be provided, which you will need to print, package your goods in a sufficient manner then proceed to your nearest post office.

We do not refund or exchange for change of mind, ordering wrong product or for damages to the product by misuse or mishandling.

Consumer Protection Law

Where the Australian Consumer Law, Schedule 2 of the Competition and Consumer Act 2010, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms will not limit your legal rights and remedies under that legislation. These Terms will be read subject to the mandatory provisions of the legislation.  If there is a conflict between these Terms and that legislation, the mandatory provisions of the legislation will apply.

When you use the Website, you may send personal information to us. You (or your licensors, as applicable) will continue to own any and all intellectual property rights in such information. These Terms are governed by the laws of the State of Victoria.

Warranty

All our goods come with a warranty that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or a refund for a major failure. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Replacement products are subject to the same warranties as the original.

You are not entitled to any compensation where in our reasonable opinion the product has, following the sale to you, become of unacceptable quality due to fair wear and tear, misuse, using it in an unusual way or failure to take reasonable care.

The Website and the Content published on it, are protected by the copyright laws of Australia and treaties around the world. All such rights are reserved.

You may print off one copy, and may download extracts, of any page(s) from our Website for your personal use and you may draw the attention of others within your organisation to content posted on the Website. Correction of Errors and Inaccuracies; Limitations on Quantity

Dog Sport Equipment  makes every effort to ensure accurate product descriptions, pricing, photographs and other information concerning the products published on the Website, we cannot guarantee that any product information is free from error, or that any product is suitable for you. Therefore, we reserve the rights to correct any information at any time without prior notice. We also reserve the right to limit quantity, including after order is submitted or paid for. We apologise for any inconvenience caused.

We endeavour to display the colours of the products on the website as accurately as possible. The colour of the product you see depends on your monitor, so it is not guaranteed that there is no colour deviation from the actual product.

Website Access

Due to random technical errors, we do not guarantee all-time access to the web site. The Terms do not guarantee that we will continue operating all or any part of the website. It is not our liability if the website is closed down or modified at any time.

You must ensure that your access to and use of the Website is not illegal or prohibited by any laws which apply to you. You are responsible for anything you do, send or post on the Website. You must not send or post anything that is offensive, infringes any person’s rights, is against any applicable law, or which we think is inappropriate.

We are not liable if products are being misused or mishandled. Our maximum total liability for any product supplied to you shall at no time exceed the amount you pay to us in respect of the product.

There are many factors beyond our control that may affect the performance or compatibility of the Website with certain software or hardware. We cannot promise that your use of the Website will be uninterrupted or error or defect free or that errors or defects in the Website will be corrected.
